Applies to Gig Workers, Businesses / Customers, visitors, and all platform users.

These Terms & Conditions ("Terms") govern your access to and use of the GigLifty platform, website, mobile applications, and related services (collectively, the "Platform"). GigLifty™ ("GigLifty," "we," "us," or "our") operates a digital marketplace that connects individuals and businesses seeking services ("Customers") with independent service Workers ("Gig Workers") who offer skills, labor, delivery, transportation, assistance, and other gig-based services.

By accessing or using GigLifty, creating an account, posting a gig, accepting a gig, or otherwise interacting with the Platform, you agree to be legally bound by these Terms. If you do not agree with these Terms, you may not access or use GigLifty.

1. About GigLifty

GigLifty is an online marketplace operated by Dewell Complex LLC designed to make it easier for gig workers and businesses to find, offer, and complete local gig opportunities.

GigLifty provides technology that enables:

  • Customers to create service requests
  • Gig workers to discover available opportunities
  • Users to communicate
  • Payments to be processed
  • Reviews and ratings to be shared
  • Trust and safety tools to be used

GigLifty is a marketplace platform and does not directly perform, supervise, or control the services provided by Gig Workers.

2. Definitions

"GigLifty" — means GigLifty™, including its website, applications, technology, and related services.

"Business / Customer" — means an individual, business, organization, or entity requesting services through the Platform.

"Gig Worker" — means an independent individual or business offering services through GigLifty.

"Gig" — means a requested task, project, service, delivery, assignment, or opportunity posted through the Platform.

"Platform" — means all GigLifty websites, applications, software, communication systems, payment systems, and related technology.

"User" — means any person accessing or using GigLifty.

3. Eligibility Requirements

To use GigLifty, you must:

  • Be legally capable of entering into an agreement
  • Provide accurate account information
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations

Gig Workers may be required to:

  • Verify identity
  • Provide payment information
  • Submit required documents
  • Complete additional verification steps

GigLifty may refuse access to any person who does not meet eligibility requirements.

4. User Accounts

4.1 Account Creation

Users must create an account before accessing certain Platform features. You agree to:

  • Provide truthful information
  • Maintain updated account details
  • Protect your login credentials
  • Notify GigLifty of unauthorized account access

You are responsible for all activity conducted through your account.

4.2 Account Restrictions

Users may not:

  • Create multiple fraudulent accounts
  • Use another person's account
  • Share account access
  • Provide false identity information
  • Circumvent Platform security measures

5. Gig Worker Independent Contractor Relationship

5.1 Independent Status

Gig Workers are independent contractors and are not employees, agents, partners, or representatives of GigLifty.

Gig Workers control:

  • Whether they accept available gigs
  • Their availability
  • Their methods of completing services
  • Their equipment and resources
  • Their business decisions

GigLifty does not guarantee:

  • A minimum number of gigs
  • Any specific earnings
  • Continued access to opportunities

5.2 No Employment Relationship

Nothing in these Terms creates:

  • An employer-employee relationship
  • A partnership
  • A franchise relationship
  • A joint venture

Gig Workers are responsible for determining their own tax obligations, insurance requirements, permits, licenses, and legal compliance.

6. Customer / Business Responsibilities

Customers / Businesses agree to:

  • Provide accurate gig descriptions
  • Provide correct location information
  • Clearly communicate expectations
  • Provide safe working conditions
  • Pay agreed amounts
  • Treat Gig Workers respectfully

Customers / Businesses may not request services that:

  • Violate laws
  • Create unsafe conditions
  • Require prohibited activities
  • Misrepresent the nature of the work

7. Gig Listings and Service Requests

Customers / Businesses are responsible for ensuring gig information is accurate.

Gig listings may include:

  • Description of services
  • Location
  • Required skills
  • Estimated completion time
  • Compensation offered
  • Special requirements

GigLifty may remove or modify listings that violate these Terms.

8. Accepting Gigs

When a Gig Worker accepts a gig:

  • The Worker agrees to complete the service professionally
  • The Customer agrees to pay applicable charges
  • Both parties agree to communicate through appropriate channels such as chat inside the platform

Gig Workers may decline or cancel gigs subject to applicable cancellation policies.

9. Payments and Fees

9.1 Payment Processing

GigLifty may use third-party payment providers to process transactions.

Users authorize GigLifty and payment partners to:

  • Process payments
  • Issue payouts
  • Handle refunds
  • Prevent fraud

9.2 GigLifty Service Fees

GigLifty may charge fees for providing marketplace access, technology, payment processing, verification, and support services.

Fees may include:

  • Customer service fees
  • Gig Worker marketplace commissions
  • Payment processing fees
  • Optional service fees

Applicable fees will be disclosed before confirmation.

9.3 Taxes

Users are responsible for their own tax obligations.

Gig Workers acknowledge that they may receive income from independent activities and are responsible for reporting earnings as required by law.

10. Ratings and Reviews

GigLifty allows users to provide ratings and feedback.

Reviews must be:

  • Honest
  • Relevant
  • Based on actual experiences

Users may not:

  • Submit fake reviews
  • Manipulate ratings
  • Threaten users for reviews
  • Exchange compensation for misleading reviews

GigLifty may remove reviews violating these Terms.

11. Safety and Trust

GigLifty promotes a safe marketplace through tools such as:

  • Account verification
  • Identity checks
  • User reporting systems
  • Safety education

However, GigLifty cannot guarantee that all users or services will be safe or satisfactory. Users should exercise reasonable judgment.

12. Background Checks

Where available, GigLifty may offer optional or required verification services.

Background checks:

  • May be performed by third-party providers
  • May require user authorization
  • May vary by location and service category

Completion of verification does not guarantee safety or performance.

13. Insurance

Gig Workers are responsible for determining appropriate insurance coverage.

Depending on the service provided, insurance may include:

  • General liability insurance
  • Vehicle insurance
  • Professional coverage
  • Equipment coverage

GigLifty does not provide insurance unless specifically stated.

14. Prohibited Activities

Users may not use GigLifty to:

  • Perform illegal activities
  • Commit fraud
  • Harass others
  • Discriminate against users
  • Circumvent payments
  • Share misleading information
  • Create fake accounts
  • Damage Platform systems
  • Upload harmful software
  • Request unsafe services

15. Fraud Prevention

GigLifty may monitor activity to detect:

  • Fraudulent payments
  • Suspicious behavior
  • Account abuse
  • Fake identities
  • Payment manipulation

GigLifty may suspend accounts during investigations.

16. Account Suspension and Termination

GigLifty may restrict or terminate access when users:

  • Violate these Terms
  • Create safety risks
  • Commit fraud
  • Abuse the Platform
  • Harm other users

Users may request review of certain enforcement actions.

17. State-Specific Compliance

GigLifty operates as a technology marketplace throughout the United States. Users are responsible for complying with all applicable federal, state, tribal, and local laws, regulations, licensing requirements, and ordinances governing the services they request or provide.

Certain states may impose additional requirements relating to:

  • Independent contractor classification
  • Consumer protection
  • Data privacy
  • Marketplace facilitator obligations
  • Insurance
  • Transportation and delivery services
  • Taxes
  • Professional licensing
  • Business registration

GigLifty may require additional documentation, certifications, licenses, insurance, or acknowledgments from Users based on the state in which services are offered or performed.

18. State Compliance Appendix

States with Standard Marketplace Requirements

The following states generally require compliance with standard business, consumer protection, and tax laws: Alabama, Alaska, Arizona, Colorado, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Utah, West Virginia, and Wyoming.

19. Marketplace Facilitator Compliance

GigLifty is a technology marketplace that connects Customers with independent Gig Providers. Unless expressly stated otherwise, GigLifty is not the seller, service provider, employer, carrier, contractor, or owner of goods or services offered through the Platform.

Where required by applicable law, GigLifty may act as a marketplace facilitator for limited purposes, including collecting and remitting certain taxes or processing payments on behalf of Users. Such activities do not create an employment, agency, partnership, or joint venture relationship between GigLifty and any User.

GigLifty reserves the right to:

  • Collect, calculate, withhold, and remit taxes where required.
  • Request additional tax information or documentation.
  • Delay or withhold payouts pending verification or legal compliance.
  • Suspend transactions that appear fraudulent or unlawful.
  • Comply with court orders, government requests, or regulatory obligations.

Users remain responsible for complying with all applicable tax, licensing, reporting, and legal obligations.

20. Restricted Items & Regulated Services Policy

GigLifty may not be used to arrange, advertise, transport, or facilitate services involving items or activities prohibited by law or by Platform policy.

Unless specifically authorized by GigLifty and permitted by law, Users may not use the Platform for:

  • Illegal drugs or controlled substances.
  • Firearms, ammunition, explosives, or regulated weapons.
  • Hazardous chemicals, toxic materials, or hazardous waste.
  • Counterfeit goods or stolen property.
  • Live animals, endangered wildlife, or protected species.
  • Human organs or biological materials.
  • Prescription medications or medical devices requiring authorization.
  • Alcohol or tobacco products where prohibited.
  • Adult products or services prohibited by law.
  • Gambling services or unlawful gaming.
  • Currency laundering or financial fraud.
  • Services requiring professional licenses that the Gig Provider does not possess.
  • Any activity prohibited by federal, state, tribal, or local law.

GigLifty reserves the right to remove listings, cancel transactions, report suspected criminal activity to appropriate authorities, and permanently suspend accounts involved in prohibited activities.

21. Multi-State Operations Policy

GigLifty is designed to operate throughout the United States. Because laws vary by jurisdiction, Platform features, eligibility requirements, verification procedures, payment methods, and available services may differ depending on the location of the Customer, Gig Provider, or requested service.

GigLifty may:

  • Restrict or prohibit certain gig categories in specific jurisdictions.
  • Require additional verification, licenses, or insurance.
  • Modify payment procedures to comply with state laws.
  • Apply jurisdiction-specific disclosures.
  • Suspend or discontinue services where required by law.

Users agree to comply with all applicable federal, state, tribal, and local laws governing the services they request or perform.

22. Insurance Requirements

GigLifty strongly recommends that Gig Providers maintain insurance appropriate for the services they perform.

Depending on the nature of the services, recommended coverage may include:

  • Commercial General Liability Insurance.
  • Professional Liability (Errors and Omissions) Insurance.
  • Commercial or Personal Automobile Liability Insurance.
  • Workers' Compensation Insurance where required by law.
  • Inland Marine or Equipment Insurance.
  • Cyber Liability Insurance for technology-related services.

GigLifty may require proof of insurance for specific service categories. Failure to maintain required insurance may result in suspension or removal from the Platform. GigLifty does not provide insurance coverage for Gig Providers unless expressly stated in a separate written agreement.

23. Compliance Verification

To protect the integrity of the Platform, GigLifty may verify compliance with applicable laws and Platform policies at any time.

Verification may include:

  • Government-issued identification.
  • Driver's license validation.
  • Vehicle registration.
  • Proof of insurance.
  • Business licenses.
  • Professional certifications.
  • Tax identification information.
  • Background screening where permitted by law.

Failure to provide requested documentation may result in account restrictions, delayed payments, suspension, or termination.

24. Government and Regulatory Cooperation

GigLifty cooperates with lawful requests from government agencies and regulatory authorities. Where required by law, GigLifty may disclose user information, transaction records, payment information, or account details in response to valid legal process, including subpoenas, court orders, warrants, or regulatory investigations.

25. Electronic Records and Electronic Signatures

By creating an account, using the Platform, or accepting these Terms electronically, Users consent to receive records, disclosures, notices, and agreements electronically.

Electronic signatures, digital acknowledgments, click-through agreements, and electronic records shall have the same legal effect as handwritten signatures to the fullest extent permitted by applicable law.

26. Force Majeure

GigLifty shall not be liable for delays or failures in performance resulting from events beyond its reasonable control, including natural disasters, pandemics, acts of government, labor disputes, power outages, internet disruptions, cyberattacks, civil unrest, war, terrorism, or failures of third-party service providers.

27. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

28. Entire Agreement

These Terms, together with the Privacy Policy, Gig Provider Agreement, Customer Agreement, Safety Policy, Community Guidelines, Payment Policy, Cancellation Policy, Acceptable Use Policy, DMCA Policy, and any additional policies incorporated by reference, constitute the entire agreement between GigLifty and its Users regarding use of the Platform.

29. Intellectual Property

All GigLifty technology, branding, designs, software, trademarks, and content belong to GigLifty or its licensors.

Users may not:

  • Copy Platform technology
  • Reverse engineer software
  • Use GigLifty branding without permission

30. Communications

By using GigLifty, you agree to receive:

  • Account notifications
  • Service updates
  • Security messages
  • Transaction communications

Marketing communications may be controlled through available preferences.

31. Privacy

Your use of GigLifty is also governed by the GigLifty Privacy Policy.

GigLifty collects and uses information to:

  • Operate the marketplace
  • Process payments
  • Improve services
  • Protect users
  • Provide support

32. Third-Party Services

GigLifty may integrate with third-party providers including:

  • Payment processors
  • Identity verification services
  • Mapping providers
  • Communication services

Third-party services may have separate terms.

33. Disclaimers

GigLifty provides a marketplace platform. GigLifty does not guarantee:

  • Availability of gigs
  • Quality of services
  • Earnings
  • User behavior
  • Completion of services

Users participate at their own discretion and risk.

34. Limitation of Liability

To the maximum extent permitted by law, GigLifty is not responsible for:

  • Injuries
  • Property damage
  • Lost income
  • Service failures
  • Disputes between users
  • Actions of Gig Workers or Customers

35. Indemnification

You agree to protect and hold harmless GigLifty from claims arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your services or transactions
  • Your unlawful conduct

36. Dispute Resolution

Users agree to attempt good-faith resolution before pursuing formal claims.

37. Arbitration Agreement

Where permitted by law, disputes may be resolved through binding arbitration instead of court proceedings.

38. Class Action Waiver

Users waive participation in class-action lawsuits to the extent allowed by applicable law.

39. Governing Law, Changes and Electronic Agreement

These Terms are governed by applicable laws of the jurisdiction where GigLifty operates, without regard to conflict-of-law principles. GigLifty may update these Terms periodically; continued use of the Platform after updates means you accept the revised Terms. Electronic acceptance, account creation, and Platform usage constitute acceptance of these Terms.
